CFPB Sues Vanderbilt Mortgage

The Consumer Financial Protection Bureau has filed a lawsuit against Vanderbilt Mortgage & Finance, a lender owned by Warren Buffett’s Berkshire Hathaway, accusing the company of issuing “unaffordable” home loans. In a complaint filed Monday, the CFPB claims that Vanderbilt knowingly approved loans for borrowers with insufficient income and assets, ignoring clear signs that they would struggle to repay.

CFPB Director Rohit Chopra said the company trapped customers in risky loans to close sales on manufactured homes, leading to defaults, added fees, and even home losses. The lawsuit seeks to protect consumers and hold lenders accountable.

Vanderbilt, a subsidiary of Clayton Homes, has not yet responded to the lawsuit. This move follows earlier calls from Congress to investigate the company’s business practices, including allegations that minority borrowers were charged higher interest rates.

Zombie Property Fees Lawsuit in NJ

A New Jersey township is set to pay $1.9 million to settle a class-action lawsuit challenging its property registration fees. A Superior Court judge has approved the settlement for Franklin Township in Gloucester County, which was accused of imposing high fees on property owners with homes labeled as vacant or abandoned.

The lawsuit, filed by Franklin Township residents David and Aimee Cappolina, claims the township’s “Vacant and Abandoned Property Registration Program” unfairly charged homeowners fees ranging from $500 to $5,000 annually—fees they argued were excessive and a form of illegal revenue generation. The township has not admitted wrongdoing but says it is settling to avoid further legal costs.

The program, which started in 2016, targeted properties in foreclosure or mortgage default, even if they were still occupied. Thousands of homeowners may benefit from the settlement, which is expected to be finalized at a fairness hearing scheduled for February 7th.

Stephen P. DeNittis, one of the attorneys involved, said the settlement could provide relief and set a precedent for other similar cases across the state.
